The parties to Roberts, et al. v. Harbor Group Management Co., LLC, et al.; Case No. 24-C-17-000509 in the Circuit Court for Baltimore City reached a settlement on or about December 5, 2018. You may review the Revised Class Action Settlement here.
The lawsuit alleges that Harbor Group Management Co., LLC and Harbor Group Management Co. (“Harbor Group”), the property management company for numerous residential properties, violated Maryland law and breached contracts by charging and/or collecting illegal or improper fees, designated as court costs, attorneys’ fees and/or legal fees. Harbor Group has denied any liability and has asserted defenses to the lawsuit.
Plaintiffs pursue the Lawsuit as a class action on behalf of all persons who are current or former tenants at a property managed by Harbor Group at some point during the period from February 2, 2014 to the present and who were charged or paid fees indicated as “court costs” “attorneys’ fees” or “legal fees” in connection with failure to pay rent actions or eviction proceedings. (the “Settlement Class”).
Copies of the Notice of Class Action Lawsuit, Proposed Settlement and Hearing will be mailed to Settlement Class members. The Notice will be in substantially the same form as the proposed Notice available for review here. The Notice contains information about the settlement fund, payment per apartment unit (which is likely to be greater than $75.00) and deadlines to opt-out of the class settlement or to object to the settlement are set forth in the Notice.
The final hearing on the settlement will take place on June 20, 2019 at 9:30 am before Videtta A. Brown, Judge, Circuit Court for Baltimore City, Maryland, 111 North Calvert Street, Baltimore, Maryland 21202.
The Circuit Court for Baltimore City has issued an Order Preliminarily Approving Settlement and Setting Schedule with Respect to Notice, Settlement Hearing and Administration. A copy of the Order is available for review here.
